What filing a 1099-NEC late costs

The penalty for a late 1099-NEC is charged per form, not per filing. That is the detail that turns an oversight into a real number: twenty contractors is twenty penalties.

The tiers, for the 2025 tax year

These are the small business rates, which apply if your average annual gross receipts are $5 million or less. Larger businesses face higher annual caps. The figures are inflation-adjusted each year, so a table you found in an old article is probably wrong.

The doubling nobody expects

There are two separate obligations: the copy that goes to the IRS, and the copy that goes to the contractor. They carry separate penalties. Miss both for the same person and the exposure for that one contractor doubles.

What reduces it

File late rather than not at all. The tier you land in is decided by when you file, so filing in February at $60 rather than September at $340 is a five-sixths reduction for doing the same work sooner.

Reasonable cause. The penalty can be waived if the failure was due to reasonable cause and not wilful neglect, which needs a written explanation of what happened and what you did about it. It is not automatic and it is not a plan.

The de minimis rule. If you filed on time but with a wrong dollar amount, and the error is no more than $100 (or $25 for tax withheld), no penalty applies for the incorrect amount.

The e-file mandate is its own trap

At ten or more information returns you must file electronically, and the count adds every type together: eight 1099-NECs plus three W-2s is eleven. Filing on paper when you were required to e-file is itself a penalty, at the same per-form rates.

Electronic filing goes through the IRS IRIS portal, which needs an access code that takes weeks to be issued. If you are near ten forms, apply for it long before January rather than discovering the requirement on the 30th.
